Emanuela Lupu

Emanuela Lupu has been providing general counsel to co-ops and condos throughout New York City, Westchester, Nassau and Suffolk counties for twenty-four years. As one of the industry’s leading co-op and condo attorneys, she brings valuable expertise and wise counsel to clients on all related board matters, including litigation, shareholder defaults, construction, financing, and corporate governance.

Emanuela is an astute litigator as well as a valuable partner and counselor for her clients. She provides guidance to co-op and condo boards on a wide variety of matters, including corporate governance, sponsor issues, construction, shareholder/unit owner defaults, fiduciary responsibilities, commercial leasing, contract negotiation, financing, and corporate document enforcement, in addition to negotiating construction contracts, commercial leases, antenna leases, laundry license agreements, shareholder alteration agreements, and management contracts. She advocates for condominium boards on construction issues and delivery of control from their sponsors, and also represents landlords and developers in refinancing underlying mortgages, financing projects, litigation, access agreements, commercial leasing and addressing other capital needs.

Emanuela serves as pro-bono counsel for the HDFC Coalition. She has been consulted as an expert in the field of co-op and condo representation by leading publications including the New York Times, Habitat Magazine and Cooperator.

• Represented a cooperative board in upholding the eviction of two residents for violating the proprietary lease provision prohibiting smoking in its building. The court found the respondents were also liable for the co-op board’s legal costs.
